GoFi Dealer Fair Lending Notice
GoFi is committed to complying with applicable consumer financial services laws, including fair lending provisions and other anti-discrimination statutes and regulations under both federal and state law. This Notice serves as a reminder that GoFi requires its Dealers to share its commitment to fair lending, including compliance with the letter and spirit of all applicable laws and regulations.
Dealers must provide equal access to credit for all qualified applicants and, more generally, must treat all customers fairly and consistently with GoFi’s policies and the Dealer Agreement. Dealer involvement in any form of unlawful credit discrimination on the basis of protected characteristics, including but not limited to race, color, religion, national origin, sex, sexual orientation, gender identity, marital status, age, disability, receipt of income derived from any public assistance program, or the good faith exercise of rights afforded under the Consumer Credit Protection Act, is strictly prohibited.
As outlined in the Dealer Agreement, Dealers are contractually obligated to comply with all applicable federal, state and local laws and regulations, including without limitation:
1. The federal Equal Credit Opportunity Act and Regulation B and similar state and local laws and regulations (“ECOA”);
2. 12 U.S.C. § 5531 (which prohibits unfair, deceptive, or abusive acts or practices and is commonly known as “UDAAP”) and similar state and local laws;
3. The Federal Trade Commission Act (commonly known as “UDAP”) and similar state and local laws;
4. All applicable implementing regulations and rules, including without limitation the Federal Trade Commission’s Trade Practice Rules and regulations and rules of the Consumer Financial Protection Bureau;
5. The federal Truth in Lending Act and Regulation Z and similar state and local laws and regulations;
6. The federal Fair Credit Reporting Act and similar state and local laws (“FCRA”);
7. Title V of the Gramm-Leach-Bliley Act and similar state and local laws (“GLBA”);
8. Laws limiting the maximum finance charge, credit service charge, time-price differential or other fees and charges related to the Vehicle or the Contract;
9. State motor vehicle installment sales acts, credit codes or similar laws; and
10. All other federal, state and local laws, regulations and rules applicable to the Vehicle sale or the Contract.
Periodically, GoFi will review contracts received from Dealers and/or related data for fair lending concerns. Based on findings from this review, or other findings of non-compliance with applicable laws orregulations, GoFi may restrict or eliminate a Dealer’s involvement and/or participation in a program, refuse to purchase contracts from the Dealer, or pursue other appropriate action.
